The US Department of Homeland Security (DHS) has added 37 new names to the Uyghur Forced Labor Prevention Act (UFLPA), which comprises some green energy companies, including Chinese vertically integrated solar PV manufacturer JA Solar’s subsidiary Donghai JA Solar Technology.The DHS announced the decision on behalf of the Forced Labor Enforcement Task Force (FLETF) rounding up companies that it believes manufacture their goods wholly or in part with forced labor from the Xinjiang Uyghur Autonomous Region (XUAR) and export to the US. Based out of China's Jiangsu province, Donghai JA Solar is involved in the research and development, and the production of silicon ingots, wafers, and solar cell modules.According to the DHS, “The United States Government has reasonable cause to believe, based on specific and articulable information, that Donghai JA Solar sources polysilicon from the XUAR. Information reviewed by the FLETF, including corporate reporting and other publicly available information, indicates that Donghai JA Solar sources polysilicon from a polysilicon producer located in the XUAR.”Along with Donghai JA Solar, some of the other additions to the list include silicon rods and wafer manufacturer Jiangsu Meike Solar Technology which is a subsidiary of Jiangsu Meike, monocrystalline silicon rods and wafer manufacturer Shuangliang Silicon Materials (Batou), Xinjiang Energy, and Hongyuan Green Energy. With these 37 names, the UFLPA Entities List now expands to 144 through which the US government wants to eliminate forced labor from its global supply chains to protect its consumers and businesses from tainted goods. It was signed into law by US President Joe Biden in December 2021 and formally implemented in June 2022.The list already includes Hoshine Silicon Industry, Daqo New Energy, Xinjiang East Hope Nonferrous Metals, and GCL New Energy Material Technology from the solar industry (see UFLPA Comes Into Force In The US). While JA Solar has yet to make a formal statement on the matter, the European Solar Stewardship Initiative (SSI) has suspended the company’s membership for the duration of the investigation. SSI verifies company sites against the SSI Supply Chain Traceability Standard (see Solar Stewardship Initiative For Solar Value Chain).
